Specific services, deliverables, timelines, fees, and other project details will be outlined in a proposal, service agreement, contract, or other written agreement between Ten Bay Consulting LLC and the client.

Services may include, but are not limited to:

  • Other marketing or consulting services agreed upon by the parties

Ten Bay reserves the right to modify or decline services based on project scope, availability, expertise, or other business considerations.

3. Client Responsibilities

Clients are responsible for providing accurate, timely, and complete information, materials, approvals, access, and feedback necessary to complete a project.

Delays in receiving required information, approvals, or materials may affect project timelines and deliverables.

Ten Bay Consulting LLC is not responsible for delays, missed deadlines, or additional costs resulting from a client's failure to provide necessary information, approvals, access, or materials in a timely manner.

4. Payments and Fees

Fees for services will be outlined in the applicable proposal, service agreement, contract, or invoice.

Payment is due according to the terms established for each project or ongoing service arrangement.

Unless otherwise agreed upon in writing, invoices are due by the stated due date. Late or unpaid invoices may result in paused or terminated services.

Additional work outside the agreed-upon scope may be billed separately with client approval.

5. Refunds and Cancellations

Because marketing and consulting services often involve time and work performed specifically for a client, fees for services already rendered are generally non-refundable.

Cancellation terms for ongoing services or specific projects will be outlined in the applicable service agreement.

If a project is canceled after work has begun, the client may be responsible for payment for work completed and expenses incurred up to the cancellation date.

6. Intellectual Property

Unless otherwise specified in a written agreement, Ten Bay Consulting LLC retains ownership of its pre-existing materials, templates, processes, systems, strategies, frameworks, and other intellectual property used in providing services.

Upon full payment, clients receive the rights to use final, client-specific deliverables created specifically for them for their intended business purposes, subject to any third-party licenses or restrictions.

Ten Bay Consulting LLC retains the right to use general knowledge, skills, processes, and experience gained during a project.

7. Client Materials

Clients retain ownership of materials, content, logos, photographs, trademarks, and other intellectual property they provide to Ten Bay Consulting LLC.

By providing these materials, the client represents that they have the necessary rights and permissions to use them and authorize Ten Bay Consulting LLC to use them for the purposes of providing the agreed-upon services.

8. Third-Party Platforms and Services

Marketing services may involve third-party platforms, including but not limited to social media platforms, website platforms, email marketing platforms, advertising platforms, analytics tools, and other software.

Ten Bay Consulting LLC does not control these third-party platforms and cannot guarantee their availability, functionality, policies, algorithms, reach, engagement, performance, or continue
